Attorneys representing Accra-based banker Ernest Kwasi Nimako have applied for a summary judgment before the High Court.
Although Deborah Seyram Adablah, a former National Service personnel, filed a substantive complaint against him, it was dismissed. Nevertheless, he feels he has shown beyond a reasonable doubt that Adablah, his opponent, has little chance of winning the ongoing petitions.
There are presently two petitions for resolution. The first is a contempt application that the banker’s attorneys filed against his ex-lover on June 6, 2023.
Deborah Adablah submitted the second application, which sought to revoke the prohibition order filed on June 15, 2023, as well as its execution and service.
Adablah’s attorneys requested a subpoena, and on Thursday, February 22, they hoped to see Ghana Police Service personnel present in court.
The former NSS employee’s attorney, Mohammed Atta, had informed the court that “we will like to subpoena the police case docket, evidently, based on the affidavit.”
The plaintiff’s attorney, Adablah, was then instructed by Justice John Bosco Nabarese to promptly file a subpoena with the police so that the Ghanaian police force could testify on February 22, 2024.
However, when Mr. Nimako, the defendant’s attorney, announced that their client had filed a motion for summary judgment, the police were not in the room.
Adablah’s attorneys, however, claim they haven’t received the most recent motion.
The motion has a return date of March 13. The case will now reopen on March 25, 2024.
