In the US & UK, a common lie by a prosecutor is enough to stop a whole trial – Kpebu

Private legal practitioner Martin Kpebu has criticized Justice Efia Serwah Asare-Botwey for dismissing the application for a mistrial in the ambulance case.

Kpebu believes that the judge could have utilized existing authorities from the United Kingdom and the United States to make a ruling that would have satisfied all parties involved. He emphasized the importance of considering arguments from defense lawyers to ensure a fair trial outcome.

In contrast, another legal practitioner, Justice Abdulai, expressed doubts about the viability of the mistrial application in Ghana, citing the lack of legal precedence in the country. Despite the dismissal of the mistrial application, Justice Abdulai highlighted the success of the defense in getting certain evidence admitted, indicating a partial victory for the applicants.

The application was filed by Dr. Cassiel Ato Forson and Richard Jakpa, who alleged inappropriate conduct by Attorney-General Godfred Dame. The court ultimately rejected the mistrial application but advised the Attorney-General to recuse himself from the case for the sake of justice and public confidence.

Godfred Dame opposed the mistrial application, arguing that it was not recognized in Ghanaian law and could be seen as an attempt to evade prosecution for financial mismanagement. He reiterated his constitutional duty to prosecute all crimes in the country, regardless of the individuals involved.

The case has sparked significant debate over the conduct of legal professionals and the integrity of the justice system in Ghana. The outcome of this trial could have far-reaching implications for future legal proceedings in the country.
