A prima facie case cannot be established without hearing from Kissi Agyebeng – Inusah Fuseini

A former Member of Parliament for the Tamale Central constituency and private legal practitioner, Inusah Fuseini, has defended the actions of Chief Justice Getrrude Korkornoo in requesting Special Prosecutor Kissi Agyebeng’s comments to determine if a prima facie case has been made against him.

According to Fuseini, the Chief Justice is mandated by law to establish whether a prima facie case exists, but cannot do so without hearing Agyebeng’s initial comments on the allegations.

Speaking on 3FM’s Midday News, Fuseini highlighted the most serious issue among the allegations raised by petitioner Martin Amidu – procurement breaches. He emphasized that if these breaches are proven true, it would be a significant matter.

Amidu’s allegations also include violations of citizens’ rights through arrests and detentions, violations of the right to information, and improper personnel appointments in the office.

Fuseini explained, “The Chief Justice is mandated under the law to establish whether or not there is a prima facie case, and the prima facie case cannot be determined without hearing from the Special Prosecutor. That is why the Chief Justice has requested the Special Prosecutor’s comments to determine if a prima facie case has been established.”

In a letter dated May 16, the Chief Justice asked Agyebeng for his comments to help ascertain if a prima facie case has been established. Amidu filed the petition against Agyebeng citing procurement breaches and abuses involving judges and the administration of justice.

Human rights lawyer Martin Kpebu has accused President Nana Addo Dankwa Akufo-Addo of being behind the petition to remove Agyebeng from office. Kpebu believes the President fears prosecution by Agyebeng after leaving office, hence the attempt to replace him with a more compliant individual.
