An interlocutory injunction against the New Patriotic Party’s (NPP) parliamentary primary in the Asante Mampong constituency was dismissed by the Court of Appeal.
Under the direction of Kofi Sarpong, some 35 NPP members succeeded in obtaining a new injunction against the primary scheduled for January 27.
The new order relates to an ongoing legal battle regarding the legitimacy of polling place elections that began in February 2022.
After more than a year of litigation, the High Court in Mampong dismissed the complaint, opening the door for elections to be held for constituency executives and electoral area coordinators.
Because of this, elections for all of the NPP’s current MP seats could not be held in Asante Mampong as planned.
However, the application was rejected on Wednesday by a three-person panel chaired by Justice Georgina Mensah-Datsa.
Thus, the court’s decision opens the door for the election’s administration to get underway.
Following the hearing, Francis Opuni Kesse, the respondents’ attorney, gave a statement to the media expressing his delight with the decision.
“We went to court based on an application for an interlocutory injunction against the conduct of parliamentary elections at Mampong and so as respondents, we opposed and counsel made their respective arguments before the court and the court held that it will better serve the party that the application be dismissed so that application is no more and so as it stands, the party can go ahead to organize elections,” he said.
Emmanuel Osei Abu-Bonsra, the plaintiffs’ attorney, stated that they will reevaluate their options for a follow-up course of action.
“Although I disagree with the verdict, I accept the court’s decision and will counsel my clients on their next course of action as we have additional options to consider.”
“We haven’t used up all of our options yet; we still have access to the Court of Appeal, the Supreme Court, and even a review,” he continued.
