The 48-year-old actress has filed a petition to establish custody and child support, according to court documents acquired by Us. Tupper, 52, is being asked to cover Heche’s legal costs throughout the legal dispute as she is requesting shared custody and “fair visitation” privileges for both parents.

Following the dissolution of her marriage to the cinematographer, Heche started dating the Big Little Lies actor.
Heche’s agent revealed that the Brave actress was expecting a child with Tupper in December 2008 after the couple moved in together in 2007.
The pair collaborated on a variety of projects when they were dating, including the NBC drama The Brave and the Syfy network’s Aftermath.
