Accident victims have up to 3 years to claim benefits – Lawyer

Jeffrey Koranteng, a certified insurer and attorney, states that people injured in auto accidents have three years to claim with their insurance company. Minors and those with disabilities have up to six years.

In an interview with The Law, he explained that the limitations on claims usually stem from the plaintiffs’ incapacity to file them right once following an accident due to injuries and other circumstances.

“If, within three years of the loss, you are harmed and end up in the hospital or whatever else, you are not eligible to report. The claim can still be submitted within the next three years.”

He stated “If somebody is a child or somebody is of an unsound mind, we call that a disability in law. So even though there’s a three-year period within which you can bring the claim, if you’re under some form of disability, then the period of limitation does not run until you are out of that disability.”

“So if you were a child, for example, that means you are below the age of 18, so that that period of limitation, which is three years, does not start to run until you come out of that disability. And if you’re out of unsound mind, that same information applies to you,” he noted.

Furthermore, Mr. Koranteng stated that victims who had property harmed during the accident have six years from the date of the incident to file a claim.

“Therefore, the statute of limitations for filing a claim is three years for injury and death and six years for property damage.”

In the meanwhile, he advised accident victims to avoid taking certain steps that can result in the denial of their insurance claims.

“I have a B license and I’m driving a vehicle that requires a C license, I haven’t been trained or certified by DVLA to drive that kind of vehicle,” he said, urging drivers to obtain the proper licenses for the vehicles they drive.

Furthermore, Mr. Koranteng stated that victims who had property harmed during the accident have six years from the date of the incident to file a claim.

Additionally, Mr. Koranteng exhorted accident victims to notify the police in addition to documenting the situation with photos and videos.
