Former President Donald Trump won a legal battle on Monday when a federal judge granted his request for a special master to examine papers that the FBI had taken from his Florida property.
The judge also temporarily stopped the Justice Department from using the materials for any investigation.
The order of U.S. District Judge Aileen Cannon permits an independent legal expert to examine the documents seized during the search on August 8 and to exclude those that may be covered by claims of executive privilege or attorney-client privilege from the rest of the inquiry.
Trump could eventually get some of the documents returned, but the judge elected not to make a ruling on that until after the examination. Despite the Justice Department’s strenuous opposition, it remains doubtful if they will carry through with an appeal against the ruling.
The legal battles for the former president have been piling up in recent times and he will be looking to make this victory a statement of his resilience and willingness to fight bad.
